Chaos & Checklists

Terms of Service

Effective date: October 27, 2026

These Terms of Service (“Terms”) apply to your access to and purchase of digital products offered under the Chaos & Checklists name. In these Terms, “Chaos & Checklists,” “we,” “us,” and “our” mean Pen Pirate Studios, LLC, doing business as Chaos & Checklists. “You” means the person or business using our website or purchasing or using our products.

By accessing our website or purchasing or using a product, you agree to these Terms. If you do not agree, do not use the website or products.

1. Our Digital Products

We offer digital products for small business owners, which may include templates, checklists, guides, and other educational or organizational resources (“Products”). Product descriptions, features, prices, and delivery methods are provided at the point of sale and may change over time.

Products are tools intended to help you organize, plan, or work on your business. You are responsible for deciding whether a Product is suitable for your needs and for how you use it.

2. No Guarantees of Results, Income, or Business Outcomes

OUR PRODUCTS ARE TOOLS ONLY. WE DO NOT GUARANTEE THAT YOU WILL ACHIEVE ANY PARTICULAR RESULT, INCLUDING BUSINESS SUCCESS, LEADS, SALES, INCOME, EARNINGS, PROFITS, GROWTH, OR ANY OTHER BUSINESS OUTCOME.

Your results depend on your own effort, decisions, implementation, and use of the Products, as well as your circumstances and other factors beyond our control. We make no promise that a Product will work for your business or produce any particular outcome. Any examples or descriptions of possible outcomes are illustrative only and are not a promise or guarantee.

You are solely responsible for your business decisions and for any results arising from them.

3. No Professional Advice

Our Products and related materials are for general informational and educational purposes only. They are not legal, financial, tax, accounting, or other professional advice, and do not create a professional-client relationship.

You should consult an appropriately qualified professional about your specific situation before making decisions that may have legal, financial, tax, or other significant consequences.

4. License to Use Products

After full payment, we grant you a limited, non-exclusive, non-transferable, revocable license to use the purchased Product for your personal use or within one business that you own or operate.

You may not, unless we give you written permission:

  • Resell, sublicense, distribute, publish, share, or provide a Product to others;
  • Use a Product for multiple businesses or for clients, customers, or other third parties;
  • Copy, modify, adapt, or create derivative works from a Product for distribution or sale;
  • Remove copyright, trademark, or other proprietary notices; or
  • Make a Product available on a shared drive, website, platform, or other location where others can access or download it.

The license ends if you materially breach these Terms. You must then stop using the Product and delete copies you control, except where applicable law requires otherwise.

5. Payment and Digital Delivery

Prices and any applicable taxes will be shown at checkout. You agree to provide accurate payment and contact information and to pay all amounts due for your order.

Payments are processed by a third-party payment processor. We do not control that processor’s systems or policies. Your payment may also be subject to the processor’s terms and privacy practices.

Products are delivered digitally, for example by download link, email, or access to an online account or platform. You are responsible for providing a valid email address and having the equipment, software, and internet access needed to receive and use the Product. If you have trouble accessing a purchase, contact us using the details in Section 12.

6. Refunds

All sales are final. We do not offer refunds, returns, or exchanges for digital Products once access or delivery has been provided.

This policy does not limit any refund, cancellation, or other right that cannot lawfully be excluded under applicable law. Where applicable law requires a remedy, we will provide the remedy required by law.

7. Ownership and Intellectual Property

We and our licensors retain all ownership rights in the Products, website, and related materials, including their text, design, graphics, branding, and other content. Buying a Product gives you the limited license described in Section 4; it does not transfer ownership to you.

You may not use our names, logos, or other brand materials in a way that suggests we endorse or are affiliated with you without our prior written permission.

8. Website and Product Availability

We may update, suspend, or discontinue any Product, website feature, or service. We do not guarantee that the website or a Product will always be available, uninterrupted, or error-free. We may correct errors in descriptions, prices, or other information, subject to applicable law and any rights you may have under that law.

9. Limitation of Liability

To the maximum extent permitted by applicable law, Chaos & Checklists and its owners, employees, contractors, and suppliers will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, income, revenue, data, goodwill, business opportunities, or business outcomes, arising out of or related to your use of the website or Products.

To the maximum extent permitted by applicable law, our total liability for all claims arising out of or related to a Product or these Terms will not exceed the amount you paid us for the Product giving rise to the claim.

Nothing in these Terms excludes or limits liability, rights, or remedies that applicable law does not allow to be excluded or limited.

10. Your Responsibility

You are responsible for your use of the Products, your business decisions, and compliance with laws and obligations that apply to you. You agree not to misuse the Products or website or use them in violation of another person’s rights or applicable law.

11. Changes to These Terms

We may update these Terms from time to time. We will post the updated Terms on our website and change the effective date above. Changes apply from the date posted, except where applicable law requires otherwise. Your continued use of the website or Products after the updated Terms take effect means you accept the updated Terms.

12. Governing Law and Contact

These Terms are governed by the laws of the State of Florida, without regard to its conflict-of-law rules, except where applicable law provides otherwise. Any dispute will be handled in the courts located in Polk County, Florida, unless applicable law requires a different forum.
